Document Requirements and Fees

Applications for a Business Tax Receipt must include a description of the type(s) of services or products the business will be offering. The broad list of business types includes a link to the required documents for the Business Tax Receipt. A regulated business will generally require a license that must be obtained before applying.

Business Office

  • Copy of Division of Corporations business name filing (LLC, INC, DBA) from www.sunbiz.org
  • Copy of any applicable licensing (e.g., Attorney Bar Card, Real Estate/Broker License)
  • Business Tax Receipt Fee: $190.30 (for each professional/classification)
  • Safety/Facility Inspection Fee: $25.00

 

Fitness Studios / Gyms

  • Health Studio License or exemptions is required from the Florida Department of Agriculture

Hair/Massage Salons

  • Original Liquor License Application (if applicable, $100.00 payable to the City of Delray Beach; a copy must be made after signing. This fee cannot be combined with the BTR payment)

Medical Office

  • Copy of Medical Professional License for each professional/classification
  • Original Medical Affidavit (signed and notarized) for each professional/classification

Medical Spa

Note: Medical spas differ from beauty spas. Any procedure involving injections, IVs, blood drawing, or invasive treatments requires a medical license from the Florida Department of Health (DOH), not DBPR.

  • Esthetician Restrictions:
    • Cannot perform injections or laser treatments
    • Microblading and microneedling require a tattoo license and must be performed in a licensed tattoo establishment

Site Survey – Floor Plan – Life Safety Plan

*Pursuant to Land Development Regulations (LDR) Section 2.4.6(C), Zoning Certificate of Use, “(2) – Submittal requirements. A completed application with a site survey, an exhibit showing the business floor plan, and any additional documentation necessary to assess the proposed use” are required.

A Life Safety Plan and analysis are “necessary additional documentation to assess the proposed use,” including a floor plan that shows all proposed indoor and outdoor seating

Accordingly, please submit a detailed Life Safety Plan and analysis, signed and sealed by a licensed architect or engineer, encompassing the entire restaurant, including outdoor seating areas. The submission must include the following:

  • A Life Safety Plan drawn to scale on a single document. At a minimum, the plan must detail:
    • Occupancy use classification(s),
    • Occupant load calculations,
    • Egress path delineations,
    • Travel distances,
    • Common path(s) of travel,
    • Exit remoteness,
    • Dead-end corridor lengths,
    • Capacities of egress components,
    • Fire ratings of doors, corridors, stairs, and other relevant egress components,
    • Exit signage and emergency lighting (if applicable), and
    • Table and chair layout, with spacing measurements to verify proper aisle access as required for restaurant layout evaluation.
  • A precise illustration of the restaurant’s seating arrangement/layout, compliant with occupancy and safety standards; floor plan showing all proposed indoor and outdoor seating.

 

Retail Business

  • Copy of Division of Corporations business name filing (LLC, INC, DBA) from www.sunbiz.org
  • Copy of Florida Annual Resale Certificate for Sales Tax (Dept. of Revenue)
  • Copy of Department of Agriculture Food Permit (if selling prepackaged food)
  • Copy of Secondhand Dealer's License (if applicable)
  • Business Tax Receipt Fee: $190.30
  • Safety/Facility Inspection Fee: $25.00

 

ATMs / Gaming Machines / Candy Machines

  • Copy of Required Documentation for ATMs from the Bureau of Financial Regulations (if applicable)
  • Details of ATM funding (e.g., bank or provider) (if applicable)
  • Business Tax Fees:
    • ATMs & Candy Machines: $46.16 per machine (candy/food machines may require a Vending License from DBPR)
    • Gaming Devices: $76.84 per machine (Restrictions may apply)
  • Safety/Facility Inspection Fee: $25.00
  • If the business is outside of Delray Beach, a Palm Beach County Business Tax Receipt is required for gaming devices or ATMs.
