At the request of the City of Delray Beach, Johnson Jackson PLLC has completed Administrative Investigation 25-002, which examined whether Fire Department personnel operated Fire Department vehicles without a valid driver’s license.
The final investigative report identified procedural and policy issues related to Fire Rescue’s driver’s license verification process, as well as gaps in administrative oversight. The investigation did not find evidence of willful, wanton, or malicious intent by any personnel to violate City or Fire Rescue policies.
Based on investigation findings:
- Todd Lynch: Returned to regular duty as of February 25, 2025, and will be reinstated to the position of Battalion Chief within 45 days, this is not a punitive action. This action honors a prior request made before the investigation commenced.
- David Wyatt: Any disciplinary considerations will be deferred until the conclusion of Administrative Investigation 25-001, which remains active.
- Calvin Smith: Although he operated department apparatus without a valid license for an extended period, the investigation found that he took immediate corrective action upon discovering the issue.
- Kevin Green: Retired from the department as of February 25, 2025.
- All Firefighters, Drivers, Lieutenants, and Captains involved: Demonstrated a clear intent to comply with City policy as soon as they became aware of their driver’s license status.
The City remains committed to ensuring compliance with all policies and procedures to uphold public safety and the integrity of Fire Rescue operations. The City will also review and strengthen administrative processes to prevent future occurrences.
“The safety of our residents and the integrity of our Fire Rescue operations are top priorities,” said City Manager Terrence Moore. “While this investigation identified areas where administrative processes could be improved, it also reaffirmed that our personnel acted in good faith. Moving forward, we will take proactive steps to strengthen our policies and oversight to prevent similar issues in the future.”
Administrative Investigation 25-001—which pertains to the December 28, 2024, traffic accident involving a Fire Rescue vehicle and a Brightline train—is still ongoing. Further updates will be provided as appropriate.
