The City of Delray Beach City Commission adopted Ordinance No. 34-26 at its August 18, 2026, regular meeting, updating the City’s development impact fees to help ensure that new development contributes appropriately toward the public facilities and infrastructure needed to serve future growth.
The ordinance amends the City’s Land Development Regulations and increases the existing parks impact fee while establishing new impact fees for municipal, police, fire rescue, water, wastewater and stormwater facilities.
As part of the ordinance, the City Commission also adopted the City of Delray Beach Development Impact Fee Justification Study, prepared by DTA Public Finance, Inc., and dated January 28, 2026. The study provides the basis for the updated and newly established impact fees.
In accordance with Section 163.31801, Florida Statutes, the City is providing the required 90-day public notice of the impact fee increases. The updated and new fees will become effective January 1, 2027, more than 90 days after adoption of the ordinance.
Development impact fees are charges assessed on new development to help offset the capital costs associated with providing public facilities and infrastructure necessary to accommodate that development. They are intended to ensure that growth contributes toward the additional public infrastructure and capacity it requires.
